Federal judge invalidates part of California's greenhouse gas law

FRESNO, Calif. ? A Fresno federal judge on Thursday dealt a setback to California's landmark global warming law, which went into effect this year with the goal of reducing the state's greenhouse gas emissions to 1990 levels by 2020.

U.S. District Judge Lawrence J. O'Neill ruled that California's Low Carbon Fuel Standard violated the U.S. Constitution's Commerce Clause.

The standard aims to gradually cut the carbon content in gasoline 10 percent by 2020 and replace up to 20 percent of the total gasoline used annually in the state with renewable fuels such as ethanol.

Several groups - including the Fresno-based Nisei Farmers League and the Fresno County Farm Bureau - filed a lawsuit in December 2009 that challenged the state regulation, saying it violated the Commerce Clause by seeking to regulate farming and ethanol production practices in other states.

A similar suit that involved oil production was filed last year by groups including the National Petrochemical Refiners Association and the American Trucking Association. It was later consolidated with the first lawsuit.

It was clear Thursday that O'Neill's ruling will be appealed. But what will happen to the state's greenhouse gas law wasn't clear - representatives of both sides of the debate were still digesting O'Neill's complicated ruling.

In a joint statement released Thursday, Renewable Fuels Association President and CEO Bob Dinneen and Growth Energy CEO Tom Buis said California "overreached in creating its low carbon fuel standard by making it unconstitutionally punitive for farmers and ethanol producers outside of the state's border."

Renewable Fuels Association and Growth Energy are both organizations that represent ethanol producers. They were plaintiffs in the first case.

The state Air Resources Board and the Natural Resources Defense Council - which intervened in the case on behalf of the state - promised an immediate appeal to the 9th U.S. Circuit Court of Appeals in San Francisco.

"We respectfully disagree with the court's decision," ARB spokesman Dave Clegern said in a statement.

He called the state's Low Carbon Fuel Standard "an evenhanded standard that encourages the use of cleaner low carbon fuels by regulating fuel providers in California. It does not discriminate against any fuels on the basis of geography."

The global warming law - which was written in the state Assembly and is often referred to by its bill name, AB 32 - sets a statewide limit on greenhouse gas emissions.

David Pettit, a senior attorney for the Natural Resources Defense Council, said a key decision will now be whether the 9th Circuit holds off on implementing O'Neill's order while it takes up the appeal.

If the appellate court lets the ruling stand while the appeal proceeds, he said it will be harder for the state to meet its goal of reducing greenhouse gas emissions.

"California's low carbon fuel standard will help reduce harmful air pollution from the fuels used by our cars and trucks, reduce our dependence in petroleum and protect public health," he said.

What O'Neill's ruling won't do, Pettit said, is completely derail the law.

Pettit said the Low Carbon Fuel Standard is only part of AB 32 and represents about 15 percent of all the greenhouse gas reductions that are part of the law.

He added that it hasn't generated the scrutiny of another part of the law - the cap and trade program. That program limits the amount of carbon emitted by the state's biggest polluters and creates allowances that can be bought and sold on an open market.

In the original lawsuit, the groups including the Renewable Fuels Association and the Nisei Farmers League said "one state cannot dictate policy for all the others, yet that is precisely what California has aimed to do through a poorly conceived and, frankly, unconstitutional (Low Carbon Fuel Standard)."

As with the Low Carbon Fuel Standard, Pettit said he expects "a lot of litigation" coming on the cap and trade program that also will invoke the Commerce Clause and the argument that "California is trying to regulate out-of-state business."

Mitsubishi Heavy Industries Ltd (MHI) has agreed with L&T Shipbuilding Ltd (LTSB), the shipbuilding arm of India?s Larsen & Toubro Ltd (L&T), under which MHI will provide a broad range of technological support to LTSB for construction of commercial vessels. The two companies will sign the technical collaboration agreement tomorrow. MHI has recently been proactively promoting development of its engineering business, centering on technology licensing, while LTSB has been seeking to strengthen its shipbuilding business through the introduction of technology from a leader in the field. In reaching the latest agreement, under which MHI will provide licensing and technology support, including training of LTSB engineers, the intentions of the two companies have thus converged.

The agreement calls for MHI initially to provide support for a period of three years, with an option to extend beyond that time frame. Specifically, support from MHI to LTSB will consist of the provision of design drawings of vessels built by MHI and a broad range of training, including areas such as design, material procurement, ship construction and quality control. Support activities will further include consultation relating to potential expansion of L&T?s shipbuilding facilities in the future and to overseas procurement of shipbuilding materials, as well as support for LTSB?s market research activities. MHI will receive payment from LTSB according to the actual support it provides. Going forward MHI and LTSB will conduct collaborative ship marketing activities by branding them as vessels built by LTSB under exclusive technical collaboration with MHI.

Based on the agreement, starting in spring of 2012 MHI will begin training of LTSB engineers at the company?s Nagasaki Shipyard & Machinery Works and the Shimonoseki Shipyard & Machinery Works in Yamaguchi Prefecture. In addition, MHI will send experts skilled in design, ship construction and quality control from its shipyards to India for training of LTSB employees.

L&T, headquartered in Mumbai on India?s west coast, is a high technology-driven engineering and construction organization and one of the largest companies in India?s private sector. Its diverse activities include shipbuilding and manufacturing of chemical plant equipment, power generation systems, and electrical and electronic products and systems. MHI and L&T have been in a partner relationship since 2007, with two joint ventures established to date in the power generation system sector.

LTSB already operates a shipyard in Hazira in India?s northwestern Gujarat state, and it is currently building a new shipyard in Kattupalli, near Chennai, in the southeastern state of Tamil Nadu.

As India enhances its infrastructure in tandem with economic expansion, the country is focusing on a growth strategy calling for basic infrastructure improvements, including better port facilities, and for the nurturing of its shipbuilding and shipping industries. As a result, the acquisition and accumulation of globally competitive shipbuilding technologies has become a challenging demand that India?s shipbuilding industry must address.

On the back of the latest shipbuilding technical collaboration agreement with LTSB, MHI now plans to step up its proactive exploration for, and aggressive development of, new engineering business opportunities relating to shipyards in the newly emerging economies.

Rutgers-Eagleton Poll: Romney Still Preferred by New Jersey GOP; Obama Looks Strong Against Top Republican Challengers

Mitt RomneyNEW BRUNSWICK, N.J ? New Jersey Republican voters continue to make former Massachusetts Gov. Mitt Romney their candidate of choice against President Barack Obama, according to a new Rutgers-Eagleton Poll. While former House Speaker Newt Gingrich has built a following here, registered Republicans and independents leaning Republican prefer Romney by 28 percent to 20 percent over Gingrich.

Texas Congressman Ron Paul runs a distance third at 5 percent; no other candidate gets more than 3 percent. More than one-third (37 percent) have no preference.

The poll also finds that Obama holds a strong lead in head-to-head matchups with all three GOP front-runners. While Romney does best, Obama leads him by 51 percent to 32 percent. The president doubles Gingrich, 54 percent to 27 percent, while Paul loses, 50 percent to 29 percent.

?New Jersey reflects the rise of Newt Gingrich seen elsewhere, though he has not managed to dethrone Mitt Romney, who has led in every poll we?ve done,? said poll director David Redlawsk, a professor of political science at Rutgers University. ?At the same time, Romney has yet to break out of the 20s in our open-ended question and more than a third have no preference at all. Gingrich is just the latest in a series of threats, which included Sarah Palin and Chris Christie early in the year, and Rick Perry and Herman Cain more recently.?

Results are from 823 registered voters drawn from a survey of 907 adult respondents conducted from Dec. 15-18. The registered voter sample has a margin of error of +/- 3.4 percentage points. The subsample of 260 registered Republicans and independents leaning Republican has a margin of error of +/- 6.0 percentage points.

The Republican race in New Jersey

Despite more than a dozen nationally televised GOP debates so far, and extensive news coverage of the campaign, 38 percent of Garden State Republicans are still not sure who to support. Although Romney has led in every Rutgers-Eagleton Poll this year, he has not been able to break away, even with Christie?s vocal support.

Although Romney leads among Republican voters, Gingrich ties the former Massachusetts governor among conservatives, at 26 percent. Moderate Republicans prefer Romney to Gingrich by 2 to 1 (28 percent to 14 percent), but are also much more likely to be unable to name any candidate. Almost half (46 percent) are unsure of their final choice compared to 30 percent of conservatives. Women are also more likely than men to be unsure: 49 percent cannot name a preferred candidate, versus 29 percent of men. Twenty-one percent of women support Romney, 15 percent Gingrich and 8 percent name Paul. Among men, 33 percent prefer Romney, 24 percent Gingrich and 4 percent Paul.

?While Governor Christie has had success getting New Jersey Republican to line up behind Romney, rank-and-file voters are not really there yet,? said Redlawsk. ?In spite of leading throughout 2011, Romney has yet to break 30 percent support. Most Republicans seem to be casting about for alternatives, if they can name any candidate at all.?

Despite lukewarm ratings, Obama strong in head-to-heads

President ObamaPerhaps benefiting from an unsettled GOP race, Obama appears to have a solid lead about 11 months before Election Day. While a November Rutgers-Eagleton Poll found only 32 percent of New Jersey voters gave Obama?s job performance an ?A? or ?B,? the president easily leads the top three Republican contenders. Romney does best (losing by 19 points) and Gingrich worst (down 27 points). Paul trails Obama by 21 points.

Two keys to the president?s strength are that Democrats are nearly united behind him and independents are currently swinging his way. More than eight in 10 Democrats support Obama against any of his challengers. Republican voters are less unified, except in the case of a Romney-Obama race. Paul does best among independents in losing to Obama by 13 points. Romney falls 15 points short and Gingrich trails by 24 points among independents.

?Several months ago we asked whether Obama deserves to be re-elected, and just about as many voters said no as yes,? said Redlawsk. ?But faced with specific challengers, voters can focus, and they now prefer to re-elect the president. Voters are not very thrilled with Obama?s job performance, but they like him better than the Republican contenders.?

The gender gap is alive and well in New Jersey, Redlawsk noted. Obama does extremely well with women, leading Romney by 30 points, Paul by 36 points and Gingrich by 37 points. The Republicans do much better among men, where Paul trails by four points, Romney by seven points and Gingrich by 15 points.

Romney holds his own among white voters; at 41 percent, he lags Obama by one percentage point. Gingrich and Paul do noticeably worse with whites: Gingrich trails, 46 percent to 35 percent, and Paul trails, 42 percent to 35 percent. Obama continues to win about 90 percent of African-American voters.

Republican candidates do best in the northwestern part of the state, with Romney and Gingrich both leading Obama in exurban New Jersey, while Paul draws even. Obama is strongest in north Jersey urban areas, leading all Republicans by about 40 points or more, though he leads in all parts of the state outside northwestern New Jersey.

?Obama?s strength reflects that New Jersey is still a Democratic state when it comes to presidential elections,? said Redlawsk. ?Overcoming that for any Republican may be tough. Of course, the election is nearly year away, and New Jersey voters have yet to become engaged in it. Once the Republicans have a nominee, we should expect to see things tighten.?

(AP) ? U.S. home prices fell in most major cities for the second straight month, further evidence that the housing recovery will be bumpy.

The Standard & Poor's/Case-Shiller index released Tuesday showed prices dropped in October from September in 19 of the 20 cities tracked.

Prices in a majority of cities declined for the second straight month, reflecting the typically fall slowdown after the peak buying season. Prior to that, prices had risen for five consecutive months in at least half of the cities tracked.

The Case-Shiller index covers half of all U.S. homes. It measures prices compared with those in January 2000 and creates a three-month moving average. The monthly data are not seasonally adjusted.

Atlanta, Detroit and Minneapolis posted the biggest monthly declines. Prices in Atlanta and Las Vegas fell to their lowest points since the housing crisis began. Prices rose in Phoenix after three straight monthly declines.

David M. Blitzer, chairman of S&P's index committee, said steep price drops in cities such as Atlanta, Chicago, Cleveland, Detroit and Minneapolis were particularly worrisome because their gains earlier this season were so strong.

"Atlanta and the Midwest are regions that really stand out in terms of recent relative weakness," Blitzer said. "These markets were some of the strongest during the spring/summer buying season."

Americans are reluctant to purchase a home more than two years after the recession officially ended. High unemployment and weak job growth have deterred many would-be buyers. Even the lowest mortgage rates in history haven't been enough to lift sales.

Some people can't qualify for loans or meet higher down payment requirements. Many with good credit and stable jobs are holding off because they fear that prices will keep falling.

Sales of previously occupied homes are barely ahead of 2008's dismal figures ? the worst in 13 years. And sales of new homes this year will likely be the worst since the government began keeping records a half century ago.

Prices are also certain to fall further once banks resume millions of foreclosures. They have been delayed because of a yearlong government investigation into mortgage lending practices.

Home prices had stabilized in coastal cities over the past six months, helped by a rush of spring buyers and investors. But this year, prices in many cities, including Cleveland, Detroit, Las Vegas, Phoenix and Tampa, have reached their lowest points since the housing bust more than four years ago.

Foreclosures and short sales ? when a lender accepts less for a home than what is owed on a mortgage ? are selling at an average discount of 20 percent.

Grammys to honor Steve Jobs

Apple co-founder Steve Jobs is receiving a posthumous Grammy for his technological innovations in the arts.

Jobs is among a dozen people, music groups or companies receiving honorary awards Feb. 11, the day before the Grammys. He died of cancer in October.

The Grammys are honoring Jobs with one of the group?s Trustees Awards, citing the late Apple boss? advancements that ?transformed the way we consume music, TV, movies, and books.?

Colbert offers cash

Comedian Stephen Colbert says he will pay half a million dollars to help fund South Carolina?s first-in-the-South GOP presidential primary.

The Palmetto State native wrote in an op-ed Thursday in the State newspaper in Columbia that his super PAC will bridge the gap after state Republicans refused to contribute anything above candidates? filing fees.

This month, Colbert offered Republicans $400,000 if they?d name the contest after him. The party said no, and Colbert says he started working with state Democrats to get an advisory referendum on the ballot.

The primary is expected to cost $1.5 million.

De Niro dad again

Robert De Niro is a father again.

Stan Rosenfield, the 68-year-old actor?s spokesman, says De Niro and his 56-year-old wife, Grace Hightower, welcomed a healthy 7-pound, 2-ounce baby girl named Helen Grace Hightower through a surrogate mother.

She is the couple?s second child.

Gibson divorced

Mel Gibson has finalized his divorce from his wife of 28 years.

Attorneys for the Oscar winner and his ex-wife appeared briefly in a Los Angeles courthouse Friday to submit a proposed judgment, which a judge signed hours later.

Robyn Gibson filed for divorce in April 2009, just months before Gibson?s then-girlfriend gave birth to a daughter.

Kim son called 'supreme leader' of NKorea military (AP)

PYONGYANG, North Korea ? North Korea hailed Kim Jong Il's son as "supreme leader" of the 1.2-million strong military, ramping up its campaign to install the young man as the nation's next leader even as the mourning for his father continued a week after his death.

Kim Jong Un made a third visit Saturday to the palace where his father's body is lying in state ? this time as "supreme leader of the revolutionary armed forces" and accompanied by North Korea's top military brass, according to the official Korean Central News Agency.

The new title and public show of support from the military leadership sent a strong signal that the nation will maintain Kim Jong Il's "military first" policy for the time being.

Earlier Saturday, the newspaper Rodong Sinmun, mouthpiece of the ruling Workers' Party, urged Kim Jong Un to accept the top military post: "Comrade Kim Jong Un, please assume the supreme commandership, as wished by the people."

Kim Jong Un, who is in his late 20s and was unveiled in September 2010 as his father's choice as successor, will be the third-generation Kim to rule the nation of 24 million. His father and grandfather led the country under different titles, and it remains unclear which other titles will be bestowed on the grandson.

Kim Il Sung, who founded North Korea in 1948, retains the title of "eternal president" even after his death in 1994.

Son Kim Jong Il ruled as chairman of the National Defense Commission, supreme commander of the Korean People's Army and general secretary of the Workers' Party.

Kim Jong Un was promoted to four-star general and appointed a vice chairman of the Central Military Commission of the Workers' Party. He had been expected to assume a number of other key posts while being groomed to succeed his father.

His father's death comes at a sensitive time for North Korea, which was in the middle of discussions with the U.S. on food aid and restarting talks to dismantle the North's nuclear weapons program. Chronically short of food and suffering from a shortfall in basic staples after several harsh seasons, officials had been asking for help feeding its people even as North Koreans prepared for 2012 celebrations marking Kim Il Sung's 100th birthday.

North Korea has emphasized the Kim family legacy during the sped-up succession movement for Kim Jong Un. State media invoked Kim Il Sung in declaring the people's support for the next leader, comparing the occasion to Kim Jong Il's ascension to "supreme commander" exactly 20 years ago Saturday.

At the Kumsusan Memorial Palace, Kim Jong Un and senior commanders paid silent tribute to Kim Jong Il, "praying for his immortality," KCNA said. The military also pledged its loyalty to Kim Jong Un, the report said.

"Let the whole army remain true to the leadership of Kim Jong Un over the army," KCNA reported ? a pledge reminiscent of those made when Kim Jong Il was named supreme commander.

The call to rally behind Kim Jong Un, dubbed the "Great Successor" in the wake of his father's death on Dec. 17 from a heart attack, comes amid displays of grief across North Korea. The official mourning period lasts until after Kim's funeral Wednesday and a memorial Thursday.

In Pyongyang, mourners waited in line Saturday to bow and lay flowers at Kim's portrait at plazas and government buildings, including the Pyongyang Circus Theater and the April 25 People's Army House of Culture, even as temperatures dropped to 14 degrees below Celsius (7 degrees Fahrenheit).

Workers at beverage kiosks handed steaming cups of water to shivering mourners, including children bundled up in colorful thick parkas. A sign urged mourners to thaw out inside a heated bus. The order to provide food and warming huts for mourners came from Kim Jong Un, officials said.

Earlier, a throng of North Koreans climbed steps and placed flowers and wreaths in a neat row below a portrait of Kim Jong Il as solemn music filled the air and young uniformed soldiers, their heads shaved, bowed before his picture.

A sobbing Jong Myong Hui, a Pyongyang citizen taking a break from shoveling snow, told AP Television News that she came out voluntarily to "clear the way for Kim Jong Il's last journey."

For days, life in Pyongyang had come to a standstill, with shops and restaurants closed. Downtown Koryo Hotel, one of several in Pyongyang catering to foreigners, was nearly empty.

But there are signs that the country is beginning to move on.

"Streets, buses and the metro are all crowded with people going to their work. They are not giving way simply to sorrow," KCNA said. "They are getting over the demise of their leader, promoted by a strong will to closely rally around respected Comrade Kim Jong Un."

Among the mourners Saturday was a son of the Rev. Sun Myung Moon, founder of the South Korean-based Unification Church, which has longstanding ties with North Korea. The Rev. Hyung-jin Moon helped carry a wreath to the main mourning site at Kim Il Sung Square in central Pyongyang.

The Korean peninsula has remained in a technical state of war since the Koreas' 1950-53 conflict, but two groups from South Korea have permission from the South Korean government to visit the North to pay their respects, Unification Ministry spokesman Choi Boh-seon said Saturday in Seoul.

One group will be led by the widow of former President Kim Dae-jung, who held a landmark summit with Kim Jong Il in 2000, and the other by the wife of a late businessman with ties to the North.

Citizens in Pyongyang, meanwhile, received a last gift from the late Kim Jong Il: fish. State-run media said Kim was worried about the supply of fish and had looked into the matter the day before he died.

Rodong Sinmun showed a photo of a woman covering her mouth as she watched herring and walleye being distributed at a crowded grocery store where they were piled up in baskets.

MONROE, NC (WBTV) - On Christmas Eve, one of the largest retail chains transformed into Santa's toy store for close to two dozen sick children.

For two hours, children and their families got $500 to spend on anything in the store they wanted.

It's all thanks to an organization called Hometown Heroes. Founded by a former Monroe police officer Donnie Dixson, the group has helped needy families for 13 years.

"It's worth the trip..we have a good time..it's fun," Dixson said.

Nicole Gordon's 5-year-old son Chase was diagnosed with nueroblastoma. She says there were times in the hospital they worried how they would have a Christmas.

But for Gordon and the other families, that's all forgotten for a few hours.

"We come in here..turn him loose and he gets what he wants," Chris Crook said. Crook's 3-year-old son Corbin is fighting a rare form of anemia.

The group raises money throughout the year with a motorcycle ride, Christmas tree sales and with the help of local businesses.

Alec Baldwin rules out NYC mayoral run (Reuters)

NEW YORK (TheWrap.com) ? Alec Baldwin says he won't run for New York City mayor -- because he isn't "horny" for the office like other candidates -- and suggested he may stay with "30 Rock," the show he had long been expected to leave after this season.

The announcement comes soon after a patch of bad publicity for Baldwin after a dispute on an American Airlines flight. He has previously described himself as "very, very interested" in running for office.

"I've lost my appetite," Baldwin said on his weekly WNYC podcast Wednesday, adding that the other candidates are "like a guy on a date that you can tell he just can't wait to get his hand up your blouse before even the lights go out in the theater."

He added: "They're all just so horny for it."

Baldwin's "30 Rock" contract ends after this season, and he said in October that he wanted to move on. But he also said at the time that he might do "a piece of the year" after this season.

On Wednesday, however, Baldwin suggested that sticking with "30 Rock" would be better than trying to run for mayor.

"Give this up for what?" he said. "I give up money and fame and position and success; I give up this wonderful life I have now in exchange for the chance to 'really change things?'... Yeah, I'm not quite sure you can anymore."

Baldwin was ejected from an American Airlines flight earlier this month after he refused to shut off his phone, which he was playing a game on.

AP Enterprise: Nonprofits aiding Paul blur a line (AP)

IOWA CITY, Iowa ? The passionate support of an eclectic group of libertarians and young people has Ron Paul in contention to win the Iowa caucus. So has the work of two well-funded nonprofits that for the past three years have kept his aides employed, his volunteers organized and his ideas afloat.

Those nonprofits, including Paul's flagship Campaign for Liberty, blur the line between his presidential campaign and issue advocacy in a way experts say runs afoul of the spirit, and perhaps the letter, of federal tax and campaign finance law.

But unlike a political campaign organization, whose finances are tightly regulated and made public, such advocacy nonprofits can raise unlimited sums of money and aren't required to disclose where it came from or all the details about how it was spent.

"It sounds like it was a way to maintain a permanent campaign," said Melanie Sloan, executive director of Citizens for Responsibility and Ethics in Washington, a nonpartisan watchdog group. "These groups were never supposed to be political organizations, but more and more, we're seeing them used that way. All of this is leading to our elections getting more and more out of control with fewer regulations."

Paul, a 76-year-old Texas congressman, finished fifth in the 2008 Iowa caucus and abandoned his long-shot presidential campaign that summer. As he left the race, he urged his supporters to continue their fight for libertarian principles by joining his new group, the Campaign for Liberty. He called the transformation of his presidential campaign into the nonprofit a "legal formality" that would allow him to continue building his famously energetic network of volunteers, online activists and college students.

The Campaign for Liberty and Young Americans for Liberty, a separate group formed to spread his message to high school and college students, were organized as "social welfare organizations" under U.S. tax law. That means they cannot make politics and promoting candidates their primary activities.

The groups quickly found a home in the tea party movement, hosting conferences, training activists and distributing petitions asking members of Congress to support one of Paul's signature policies ? a plan to audit the Federal Reserve. The Campaign for Liberty raised more than $13 million between 2008 and 2010 that paid for direct mail, telemarketing, staff salaries and other expenses. The group claims more than 600,000 members and more than 170 chapters of Young Americans for Liberty at high schools and colleges.

Drew Ivers, who founded the Iowa chapter of Campaign for Liberty, said the nonprofit's goal was never to lay the groundwork for Paul's 2012 presidential campaign. Organizers were careful to separate political work from the work of advocating Paul's ideas, he added. But he acknowledged the organization has helped Paul in Iowa, which will hold its first-in-the-nation presidential nominating caucuses on Jan. 3.

"It kept the ideas alive. And as people who were involved in the Campaign for Liberty liked the idea of limited government, they look at the field of presidential candidates and say, `You know, I think Ron Paul is serious about this idea,'" Ivers said.

The other candidates from 2008 who are again running in 2012 also took steps between campaigns to build their political clout. President Barack Obama formed his "Organizing for America" group at the Democratic National Committee, while Republican Mitt Romney used a political action committee to raise money, shower donations on lawmakers and pay for his travel to key states. Paul had a PAC, too.

But the finances of both the DNC and political action committees such as Romney's Free and Strong America PAC ? unlike Paul's nonprofits ? are regulated by the Federal Election Commission and subject to financial disclosure rules.

Paul's presidential campaign is thoroughly intertwined with the nonprofits. The Campaign for Liberty calls itself a lobbying group for "individual liberty, constitutional government, sound money, free markets and a noninterventionist foreign policy" ? a tidy summation of Paul's campaign platform. Young Americans for Liberty's support of Paul is even more explicit, calling itself the continuation of the Students for Ron Paul wing of his 2008 campaign, coordinating his visits to campuses and publishing a magazine in which he laid out his "agenda for a freedom president."

Between the 2008 and 2012 campaigns, both nonprofits were stocked with Paul aides and relatives. Ivers served as Paul's Iowa campaign chairman in 2008 and holds the same position again this year. The Campaign for Liberty's president, John Tate, was paid a total of $338,000 by the group in 2009 and 2010. He is now Paul's national campaign manager. The nonprofit's senior vice president was Jesse Benton, who is now Paul's campaign chairman; its vice president was Debbie Hopper, who is now Paul's assistant campaign manager.

Lori Pyeatt, Paul's daughter, served until recently as the Campaign for Liberty's part-time secretary and treasurer, earning $34,000 for her work last year. Her daughter is married to Benton. Paul's son Ronnie is the group's unpaid chairman.

In all, nine out of the 16 staff members at the Campaign for Liberty are on leaves of absence from the group to work for Paul's campaign. The nonprofit's executive director, Matthew Hawes, said the group is still able to function and is an active advocate on state and federal issues unrelated to Paul's presidential campaign.

Paul campaign spokesman Gary Howard ? who for 18 months served as the Campaign for Liberty's spokesman ? said Paul resigned as Campaign for Liberty's honorary chairman when he joined the presidential race and believes the nonprofits complied with Internal Revenue Service rules. Still, like Ivers, he acknowledged the nonprofits have indirectly aided the campaign by training activists and raising his issues.

Paul isn't the first to use such a strategy to keep his name in the public's view between bids for the White House. Democrat John Edwards did the same between the 2004 and 2008 campaigns by founding a nonprofit center dedicated to fighting poverty, his central campaign issue.

Federal investigators later issued a subpoena for information about Edwards' nonprofit, according to details previously provided to The Associated Press. An attorney for Edwards has said the nonprofit paid money to Edwards' mistress' video production firm, and the former senator from North Carolina was later indicted on campaign finance charges related to payments from wealthy donors that were used to help hide the woman.

Marcus Owens, a Washington lawyer who headed the exempt organizations division at the IRS from 1990 to 2000, questions whether such nonprofits were truly designed to serve the "social welfare purpose" as required by law.

In Paul's case, the groups also helped his son's political career. At least two aides from the Campaign for Liberty left to help Rand Paul win election to the U.S. Senate in Kentucky last year.

"Any family campaign seems to draw them out. It's not conclusive, but it tends to suggest a private, not a public, purpose behind the organization," Owens said. "It's not a social welfare purpose to keep a campaign staff together and to promote the personal ideas of one individual."

Russian Rocket Launches Astronauts on Holiday Space Station Trip (SPACE.com)

Three spaceflyers blasted off today (Dec. 21) from snowy Kazakhstan to spend the holidays on the International Space Station.

NASA astronaut Don Pettit, Russian cosmonaut Oleg Kononenko, and Dutch astronaut Andre Kuipers, part of the European Space Agency (ESA), lifted off atop the Russian Soyuz TMA-03M spacecraft from Baikonur Cosmodrome in Kazakhstan at 8:16 a.m. EST (1316 GMT).

The trio is bound for the space station, where they are scheduled to dock on Friday (Dec. 23) at 10:22 a.m. EST (1522 GMT). They are set to begin a roughly five-month stay on the orbiting outpost as part of the station's Expedition 30 mission, and will return in May 2012.

Pettit, Kononenko and Kuipers will join the three spaceflyers already on the station: commander Daniel Burbank of NASA and flight engineers Anton Shkaplerov and Anatoly Ivanishin of Russia. Their arrival will beef up the station's crew complement to its full six members.

Holiday celebrations

The new arrivals will find the space laboratory festive for the holidays. The current crew has put up holiday decorations to mark the season, and Burbank sent a holiday greeting video down to the people of Earth. [Space Station Commander Sends Holiday Greetings to Earth]

"We'll celebrate the holidays in great fashion after they get here," Burbank said of the new crewmembers. "We've already put up decorations, and we've gathered together all the cards and gifts that our friends and families have sent to us, and we're planning a couple of big meals. That'll be great."

Pettit, Kononenko and Kuipers, each veteran spaceflyers who've been to the space station before, will also have their work cut out for them once they arrive at their new home-away-from-home. In addition to wide-ranging scientific research projects, the crewmembers will spend their time keeping up the station and fixing anything that might break.

"If liquid's squirting out someplace then it's like I'm a plumber for the day; if an electronics box isn't working right then you're an electrical repairman for the day," Pettit said during a press conference a few months before the launch. "You have to remember that the space station is so complicated, no one person could keep all the details in your mind. That's why we need all the folks on the ground."

The presence of six crewmembers onboard the station will allow each spaceflyer to dig deep into research.

"I think I have something like 57 experiments from NASA, from ESA and also from JAXA," the Japan Aerospace Exploration Agency, Kuipers said in a press conference earlier this year. "There's a whole bunch of experiments that I'm looking forward to, experiments in different fields ? fluid physiology, fluid physics."

Milestone event

The Expedition 30 team is also scheduled to be in space for a milestone event coming up.

On Feb. 7, the first commercial spacecraft to visit the International Space Station is set to launch. The SpaceX Dragon capsule will be making its first cargo delivery run as part of a NASA program to encourage the development of private spacecraft to help fill the gap left by the retirement of the space shuttles this summer.

The unmanned Dragon is due to launch on SpaceX's Falcon 9 rocket, and make an autonomous rendezvous with the space station. Once within reach, the crew inside the station will grab onto the freighter will the station's robotic arm and berth it on the lab.

"We've been practicing the dynamics of how you do that and we practice that a lot," Pettit said. "Once you get these docked to station, it's pretty much standard operations."

After about three months in space, the Expedition 30 mission will change over to Expedition 31, and Kononenko will take over command of the station. There will be many differences for him between this trip and his previous sojourn to the orbiting lab in 2008, including a potential for two spacewalks (or extravehicular activities, also known as EVAs) in 2012.

"A lot of things changed for me," Kononenko told SPACE.com in a prelaunch interview. "First I'm going to fly to the station as a Soyuz commander and later become comrade of the International Space Station ? that's a really big transition for me. The station itself became more interesting over these couple years, new modules appeared, new systems were installed. Of course the EVA I'm going to perform has new tasks and new objectives and I'm looking forward to them."

Tough year

The launch comes at the end of a tough year for Russia's space agency.

Today's launch was delayed by about a month in the wake of a failed Russian cargo ship launch in August atop a rocket similar to the Soyuz that lifted off today. Russian spacecraft were grounded while officials investigated the problem, which was eventually traced back to a malfunctioning gas generator in the Soyuz?s third stage engine.

At the end of October, Russia successfully launched another cargo vehicle, and on Nov. 14, Burbank, Shkaplerov and Ivanishinlaunched safely to the station atop a Soyuz rocket.

Russia also suffered the loss of its unmanned Phobos-Grunt probe, which lifted off Nov. 8 to collect samples from Mars' moon Phobos. However, the vehicle failed to fire its thrusters toward Mars, and has been stranded, and largely unresponsive, in Earth orbit. Experts expect it to fall back to Earth as a piece of space debris in January.

Phobos-Grunt was the 19th spacecraft Russia has launched toward Mars since 1960. None of them have been fully successful.?

China's rebellious villagers halt protest after apparent intervention

WUKAN, China ? A tense standoff between rebellious villagers and local officials in this fishing town on China's eastern coast appeared to come to an end on Wednesday, though the tentative agreement did not untangle allegations of official corruption and land grabs.

Stretching more than a week, the takeover of Wukan from police and officials was arguably the most dramatic example of social unrest in a year marked by bursts of tumult around the country.

Like similar incidents, the end of the episode here seemed to raise as many questions as it answered. Taken as a whole, such cases have pointed to a complicated matter for Beijing ? the nation's development efforts are at times implemented by crooked officials.

There's ample argument that as the nation continues its economic ascent, the widespread practice of individual farmers working tiny plots of land, as was the case in Wukan, will have to be transformed. That idea folds neatly into central leadership's desires to shift from cheap, labor-intensive industry to an economy that creates wealth from domestic consumption, high-tech innovation and an expanding service sector.

But when villages like Wukan explode with anger, it is almost inevitably accompanied by accusations that those in charge of the transition are guilty of thefts, large and small.

In a meeting earlier this week, the Chinese Communist Party secretary of the city with oversight of Wukan bemoaned the difficulty of dealing with common people during an address to officials in Shanwei.

Dressed in a black Ralph Lauren windbreaker, the pudgy man with bags under his eyes, Zheng Yanxiong, noted they are becoming "harder to control."

Across Wukan, locals said that in the past two decades most of the village's farmland was whittled away by greedy officials without notice or payment. By the end of that process, capped by construction workers breaking ground on a controversial project in September, many here said they were left with literally nothing to do for a living. Riots followed.

The Communist Party secretary of Wukan, Xue Chang, ruled the village for decades in a style that residents described as dictatorial. Xue and another senior official in the village have reportedly been taken in for questioning. Locals, though, angrily pointed out that they had begged authorities for years to intervene and were ignored until staging a revolt.

The problem appeared so intractable that Wukan protest leaders dropped the return of their land from a list of demands presented to Guangdong's deputy party secretary, Zhu Mingguo, on Wednesday morning. If no agreement had been reached in the meeting, organizers planned a march of thousands on a government building in the neighboring town of Lufeng ? leaving open the possibility of a chaotic confrontation with police.

The prospect of violence made some villagers nervous and seemed to have the same effect on officials in the nation's most populace province and the center of its export industry.

The Communist Party secretary of Guangdong Province, Wang Yang, is frequently mentioned as a likely candidate for the nation's ruling politburo standing committee next year.

Wang's lieutenant agreed to deliver the body of a Wukan advocate who died in police custody, release three men currently being detained and recognize the legitimacy of a temporary council formed by villagers, said de facto village leader Lin Zuluan.

Five Favorite Films with Emile Hirsch

Whether he's piloting futuristic racing cars around a kaleidoscopic funhouse or perishing earnestly in the North American wilderness, Emile Hirsch has been steadily building a solid acting resume that surely hints of some great work to come. And though he's been relatively quiet since roles in Gus van Sant's Milk and Ang Lee's Taking Woodstock, the young actor is set to return with a bunch of new films, the first of which -- opening in theaters this week -- is the sci-fi action thriller The Darkest Hour, the debut feature for visual effects expert-turned-director Chris Gorak, produced by Timur Bekmambetov. Hirsch stars, alongside Olivia Thirlby, as a young American traveler in Moscow who finds himself pitted against a deadly, literally electric invasion by power-hungry aliens. Well now, that's not good for tourism, Timur. We had a chance to chat with Hirsch recently, where he obliged us with his five favorite films... and an impromptu exegesis of Terrence Malick.


This'll be my five favorite films of this moment. I really love A Streetcar Named Desire. With Streetcar Named Desire, and On the Waterfront -- those are like the Brando movies that I think are so essential to the growth of film acting in general; I mean, Brando came along and changed the game.

The Matrix (Larry Wachowski and Andy Wachowski, 1999; 87% Tomatometer)

The Matrix was just such an incredible cinematic experience. I saw it when I was 13, in the cinema. I didn't know anything about it -- I hadn't seen the trailer. It just blew my mind. I didn't know anything about it when I first saw it. And I was lucky enough to be able to work with the Wachowskis later, years later, on Speed Racer, which I had a great time on.

Raging Bull was just an incredible performance by Robert De Niro. A great, you know, show of discipline by an actor. And Martin Scorsese... visually, it was just so cool.

The Usual Suspects was Bryan Singer's masterpiece. It was such a great ensemble and such a smartly-told film. The twist at the end was just fantastic. That movie kicked so much ass.

The English Patient I saw when I was really young, and the love story just devastated me, I think. You know, I was just sobbing. I loved it. Beautiful images. Something that can evoke that much emotion out of me -- I was just really moved. So those are five that just come straight to the surface. You must get all kinds of people naming these obscure-ass movies though, right?

Most people tend to be pretty honest; unless they're, you know---

Trying to be assh---s. [Laughs] Did you see The Tree of Life?

Yeah, I loved it.

I thought it was amazing. All the shots of the bacteria, when you see them bubbling for the first time, all the gasses and the fluid. And you see the little helixes swimming toward the surface together. I thought that was so amazing.

I could've watched that sequence for two hours.

Yeah. People were complaining about the cosmos shots and the life shots but I found that infinitely great. It's such a good film. So beautifully shot and acted. Another thing I really loved about it was the way in which you see the evolution of innocence to experience with these young boys, and how these young boys kind of become a metaphor for the human race; of how our species is just naturally corrupted with time. You're born good but you eventually see this dark side as you get older; like when the boys get together and they're killing things -- it's not that they're raised wrong, it just happens naturally. And then [the movie's] like trying to go back to that state of grace, you know? I loved that movie. What do you think that doorway represented? Cause it keeps cutting back to that doorway. I think it represented the transition from life to death, but the reason it's on the beach -- it's the solitary doorway -- is because there's no real difference: death, in a certain sense, is an illusion of change. You're still in the same area -- it's like you can pass through this manifest doorway but you're still in the exact same area as you were before.



The Darkest Hour opens in theaters this week.

(AP) ? The Senate-approved bill temporarily preventing a Jan. 1 payroll tax increase and benefit cutoff for the long-term unemployed faces uncertain prospects in the House, where many rank-and-file GOP lawmakers have told their leaders they are ready to reject the measure.

House Speaker John Boehner is expected to be pressed about the next move for Republicans when he appears on NBC's "Meet the Press" show Sunday morning.

The House plans a Monday vote on the bill, which also forces a reluctant President Barack Obama to make an election-year choice between unions and environmentalists over whether to build an oil pipeline through the heart of the country and across ecologically sensitive aquifer that provides water to eight states.

The 89-10 Senate vote Saturday came after a bruising battle between Democrats and Republicans that produced the compromise two-month extension of the expiring tax breaks and jobless benefits and forestalled cuts in doctors' Medicare reimbursements.

House GOP leaders held a conference call Saturday with rank-and-file lawmakers in which participants said strong anger was expressed about the Senate bill, including its lack of House-approved cuts in last year's health care overhaul law and its failure to erase the reductions in doctors' payments for more than two months.

"You can't have an economic recovery with this," Rep. Jack Kingston, R-Ga., said of the bill.

A House GOP aide said later, "Members are overwhelmingly disappointed in the Senate's decision to just 'kick the can down the road' for two months."

The Senate vote capped a year of divided government marked by raucous partisan fights that tumbled to the brink of a first-ever U.S. default on its debts and three federal shutdowns, only to see eleventh-hour deals emerge. It also put the two sides on track to revisit the payroll tax cut early next year as battles for control of the White House and Congress heat up.

While Obama and Democrats used the fight to portray themselves as defenders of beleaguered middle- and lower-income Americans, Republicans used it to cast themselves as champions of job creation.

Democrats said when Congress revisits the issue of renewing the tax cuts and jobless benefits early next year, they would win the political battle because they would be viewed as protecting peoples' household budgets.

Republicans, though, said they would once again focus the fight on jobs, with some predicting they would try adding provisions to repeal pollution curbs and other government regulations that they say make it harder for companies to hire people.

Syrians protest against Assad after Russia UN move (Reuters)

BEIRUT (Reuters) ? Syrian forces killed 13 people on Friday during widespread protests against President Bashar al-Assad, activists said, a day after Syria's big power ally Russia sharpened its criticism of Damascus in a draft United Nations resolution.

Most of the deaths were in the city of Homs, they said, a hotbed of resistance to a crackdown on nine months of protests which has killed 5,000 people according to the United Nations and provoked Western and Arab League sanctions on Damascus.

State media said there were no deaths or injuries on Friday, despite what they said were attacks by "armed terrorist groups" on security forces. Syria has barred most independent media, making it hard to verify accounts by activists and authorities.

About 200,000 people marched in separate districts of Homs, the British-based Syrian Observatory for Human Rights said, and footage broadcast by Al Jazeera television showed mock gallows where effigies were hanged, including two of Assad and his father, who seized power in Syria four decades ago.

If confirmed, it would be one the biggest turnouts by demonstrators for several weeks.

Russia presented a new, beefed-up draft resolution on the violence to the U.N. Security Council on Thursday, offering a chance for the 15-nation panel to overcome deadlock and deliver its first statement of purpose on Assad's crackdown.

The council has been split, with Western countries harshly critical of Syria pitted against Russia, China and non-aligned countries that have avoided blaming Assad for the violence.

France, which has led Western rebukes of Assad, welcomed what it said was Moscow's recognition of the deteriorating situation in Syria, but said Russia was wrong to equate Assad's crackdown with violence perpetrated by his opponents.

Assad has denied that Syrian forces have been ordered to kill demonstrators, blaming armed groups for the bloodshed. He said 1,100 soldiers and police have been killed since the uprising erupted in March, inspired by other unrest in the Arab world that has toppled three autocratic leaders this year.

An armed insurgency has begun to eclipse civilian protests, raising fears Syria could descend into civil war. On Thursday army deserters killed 27 soldiers and security personnel in the southern province of Deraa, an activist group said.

State news agency SANA reported that security forces defused several explosives in Damascus and Hama provinces on Friday.

It is the most serious challenge to the 11-year rule of Assad, 46, whose family is from the minority Alawite sect and has ruled majority Sunni Muslim Syria since 1970.

The United States and European Union have imposed sanctions and called on Assad to step down. Neighboring Turkey has taken similar steps and even the Arab League has declared sanctions against Syria, although it has several times extended a deadline for Syria to approve a formula for ending the crisis.

In the latest sign of the heavy economic price Syria is paying for its repression of dissent, Turkey said on Friday that Damascus would lose more than $100 million a year in transport revenue as Ankara bypasses the turbulent country by opening alternative export routes to the Middle East and Gulf.

"ARAB LEAGUE IS KILLING US"

Arab governments called off a foreign ministers' meeting due to discuss a response on Saturday to Assad's iron fist policy towards unrest, Egypt's state news agency MENA reported.

A source at Arab League headquarters in Cairo gave no reason for the cancellation. A lower-level meeting of its ministerial committee on Syria will go ahead in Qatar on Saturday, the source said. The committee includes the foreign ministers of Egypt, Sudan, Oman, Qatar and Algeria.

Friday's protests were held under the slogan of "The Arab League is Killing us," reflecting demonstrators' frustration at what they see as the organization's ineffective response.

At the U.N. Security Council in October, Russia and China vetoed a European draft resolution that threatened sanctions. Russia has circulated its own draft twice but it was criticized by Western nations for blaming the violence equally on the government and opposition.

The draft floated unexpectedly by Russia on Thursday expands and toughens Moscow's previous text, adding a new reference to "disproportionate use of force by Syrian authorities.

Obtained by Reuters, the draft also "urges the Syrian government to put an end to suppression of those exercising their rights to freedom of expression, peaceful assembly and association."

Reports by Human Rights Watch and a U.N.-backed independent investigation have concluded that Syrian government forces were given "shoot to kill" orders when confronting demonstrators.

STRONGER TEXT

Russia's U.N. Ambassador, Vitaly Churkin, told reporters that the latest draft resolution "considerably strengthens all aspects of the previous text" and that "clearly the Syrian authorities are singled out in a number of instances."

He said Russia did not believe both sides in Syria were equally responsible for violence, but acknowledged the text called on all parties to halt violence and contained no threat of sanctions, which he said Moscow continued to oppose.

Western officials welcomed the move but Paris said the draft "has elements that are not acceptable in their current form."

"For France, it is a positive development that Russia has decided to recognize that the serious deterioration of the situation in Syria merits a Security Council resolution," Foreign Ministry spokesman Bernard Valero told a news briefing.

Calling the council's inaction scandalous, Valero said a resolution should be swiftly adopted to condemn crimes against humanity in Syria and back a credible political solution.

U.S. Defence Secretary Leon Panetta told reporters in Ankara that the Russian draft showed the international community was increasingly coming together to "say to Syria and to the Assad regime that we can no longer tolerate the kind of killings that have gone on...(and) that Assad needs to step down."

Senate leaders say nearing deals on budget, tax bills (Reuters)

WASHINGTON (Reuters) ? Democratic and Republican leaders in the U.S. Senate on Thursday expressed optimism that they can soon strike compromises on bills to keep the government running through September 30 and extend a payroll tax cut for one more year.

Senate Majority Leader Harry Reid said he hoped that negotiations will pave the way for Congress to wrap up its 2011 session "in the next few days." Senate Republican leader Mitch McConnell said he was "confident and optimistic we'll be able to resolve both (bills) on a bipartisan basis." An extension of unemployment benefits is also expected to be part of a deal.

Shock jock Howard Stern gets "America's Got Talent" gig (Reuters)

LOS ANGELES (Reuters) ? Controversial radio shock jock Howard Stern will be the new judge on TV show "America's Got Talent", NBC said on Thursday, and will also continue to host his daily radio program for SiriusXM.

Stern, 57, will replace departing talk show host Piers Morgan on the panel when the talent show returns for a 7th season in the summer of 2012.

Production of the show will move to New York to accommodate Stern's schedule.

"Howard Stern's larger-than-life personality will bring a thrilling new dynamic to 'America's Got Talent' starting this summer," said NBC alternative programming chief Paul Telegdy.

"He's a proven innovator and his track record in broadcasting is truly remarkable. Howard is very passionate about this show and is fully committed to its future," Telegdy said in a statement.

Stern is known for conducting sexually explicit interviews, his raunchy sense of humor and for his satirical comments on religion, race and other hot button topics.

"America's Got Talent" created by British entrepreneur Simon Cowell, is one of the most successful shows for NBC and the outspoken Stern had been Cowell's top choice to join the judging panel.

Per his petition filed in Williamson County, Tennessee on Nov. 22, the day after he was taken into custody, Atkins cited irreconcilable differences as the reason as well as "inappropriate marital conduct" on Tammy Jo Atkins' part that "renders further cohabitation unsafe and improper."

The 42-year-old entertainer was taken into custody after his missus called 911, claiming the two had got into a violent altercation that culminated with him trying to smother her with a pillow. She also alleged he grabbed her face and threw her down a hallway in front of their 10-year-old son, Elijah.

Rodney Atkins has adamantly denied the accusations.

On the same day he moved to dissolve their marriage, a judge signed a temporary restraining order prohibiting both Rodney and Tammy from "harassing, threatening, assaulting or abusing the other party."

Additionally, the court barred them from disposing of any marital property or relocating their children outside the state without the court's permission (Rodney also has two step-daughters).

In her counter-complaint, Tammy also cites irreconcilable differences and asks that the court grant her sole custody of the boy. In addition, she's seeking alimony, child support and legal fees from her estranged hubby.
